Terms of service

These terms apply when you use theloftfmb.com, book a stay with us, or receive text messages from us. “The Loft FMB”, “we” and “us” mean The Loft FMB, 923 Third Street, Fort Myers Beach, FL 33931, run by your hosts Chris and Jake. Please also read our privacy policy, which explains how we handle your information.

Text message (SMS) terms

Program name: The Loft FMB Guest Messages.

What we text: messages about your reservation and stay, such as booking confirmations and updates, payment details if you choose to pay by Zelle, cash or check, your door code and check-in information, changes or problems with your booking (for example, a refund if your dates were taken while you were checking out), and replies to questions you send us through our website, chat or by text. We do not send marketing or promotional texts.

How you sign up: you agree to receive these texts when you enter your mobile number while booking on our website, or when you give us your mobile number in our contact form or website chat and ask us to get back to you. You can also text START to 239.356.8484 (see text updates), or text us first. Consent to receive text messages is not a condition of any purchase: if you would rather not get texts, reply STOP and we’ll send what you need by email instead.

How often: message frequency varies. Most guests get a few messages per booking, mostly in the days before arrival and during their stay.

Cost: message and data rates may apply. Check with your mobile carrier for details of your plan.

Opting out: reply STOP to any message to stop receiving texts. We’ll send one message to confirm you’ve been unsubscribed, and then no more. To start again, reply START.

Mobile carriers are not liable for delayed or undelivered messages. We send texts to US mobile numbers through our messaging provider, Twilio. Your mobile number and your agreement to receive texts are never shared with or sold to third parties or affiliates for marketing purposes. See the text messages section of our privacy policy.

Bookings

  • Your booking is confirmed once we’ve received payment and you get our confirmation. If you choose Zelle, cash or check, your dates are held for 48 hours while you pay; after that we may cancel the booking.
  • Prices shown on our website include cleaning. Taxes are added at checkout. Card payments include a card processing fee, shown before you pay.
  • Only the number of guests in the booking may stay overnight.
  • Check-in is from 4pm and check-out is by 10am. Contactless self check-in with a door code we text you before you arrive.
  • Occasionally a date can be booked by someone else while you’re checking out. If that happens after you’ve paid, we refund you in full and let you know right away.

Cancellations

Guests can cancel until 30 days before check-in for a full refund including taxes. For any other change or cancellation, contact us.

House rules

  • Quiet hours are 10pm to 8am, out of respect for our neighbors.
  • No smoking or vaping indoors.
  • One free on-site parking space for a standard vehicle.
  • The Loft is an elevated home, so every unit is reached by stairs. There is no elevator.
  • Please treat the home and the free beach gear with care. You’re responsible for any damage beyond normal wear during your stay.

We may end a stay without a refund if these rules are seriously broken or our neighbors’ safety or peace is put at risk.

Your safety

Please take care on stairs, on bikes, in the sun and in the water: there are no lifeguards on most of Fort Myers Beach. Beach gear and bikes we lend are used at your own risk. To the extent the law allows, we aren’t liable for injury, loss or damage that we didn’t cause, or for things outside our control such as storms, evacuations, power or water outages, or construction nearby.

Using our website

  • We work to keep prices, availability, photos and descriptions accurate, but mistakes can happen. If we find an error in a booking, we’ll contact you before your stay to put it right or refund you.
  • Weather, webcam and local guide information is provided for convenience and may not be current.
  • Please don’t misuse the website, such as by trying to break into it, overload it or send spam through its forms.
  • The words and photos on this website belong to The Loft FMB and may not be copied without our permission.

Changes and law

We may update these terms. The version on this page when you book applies to your booking. These terms are governed by the laws of the State of Florida, and any dispute will be handled in the courts of Lee County, Florida.
